RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03475 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be reimbursed for the remaining balance of the cost to ship his motorcycle during his a permanent change of station (PCS) from Washington D.C. to Manila, Philippines. APPLICANT CONTENDS THAT: He was misinformed by the transportation management office (TMO) at Bolling AFB/Fort Belvoir prior to his PCS that he was not authorized to ship his motorcycle via Household Goods (HHG) shipment. He was only reimbursed $561.11 by the TMO via the personally procured move (PPM) process, and requests reimbursement for the remaining balance of $1,554.39. In support of his request, the applicant submits copies of email correspondence, his PCS orders and documentation pertaining to his HHG and motorcycle shipment. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Major (Maj), O-4. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force at Exhibit C. AIR FORCE EVALUATION: PPA/ECAF recommends approval. ECAF states that per Special Order AF104131 dated 21 June 2012, the applicant was reassigned on a permanent change of station (PCS) from Washington, District of Columbia, to Manila, Philippines, with a report no later than date of 30 September 2012. Incident to the PCS, the applicant effected a shipment of HHG at government expense, and personally arranged to ship his motorcycle to the Philippines. The Personal Property Consignment Instruction Guide (PPCIG) authorizes one privately owned vehicle (POV) to be shipped to the Philippines, tax free, at government expense through a vehicle-processing center (VPC). The PPCIG also advises that motorcycles over 49cc are considered POVs for registration purposes. The JFTR advises that members have the option of determining a motorcycle to be either HHG or POV for shipping purposes. The applicant shipped a car through the VPC; therefore, he was not authorized to ship the motorcycle through the VPC as a vehicle. However, the motorcycle qualifies as HHG and he was authorized to ship it to the Philippines as HHG. It appears consideration was not given for the motorcycle to be considered as HHG, subsequently requiring the applicant to make personal arrangements to have the motorcycle shipped at his own expense. He was only reimbursed the cost the government would have paid had the motorcycle been included with the HHG shipment. Based on the above, they recommend approval of the applicant's request for reimbursement for the total cost to have his motorcycle shipped to the Philippines. The complete PPA/ECAF evaluation is at Exhibit C APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the additional Air Force evaluation (Exhibit D) was forwarded to the applicant on 10 January 2014 for review and comment within 30 days. To date, a response has not been received. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice warranting corrective action. We took notice of the applicant’s complete submission in judging the merits of the case and agree with PPA/ECAF’s determination that the applicant should be reimbursed for his out-of-pocket expenses related to the shipment of his motorcycle as a personally procured move (PPM). In this respect, we agree with the office of primary responsibility that the applicant may not have been provided appropriate counseling concerning entitlements for shipment of privately owned vehicle. Accordingly, we recommend his records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that competent authority approved: a. Transport of his motorcycle at personal expense. b. He be reimbursed, $1,554.39, the remaining balance of the cost paid for shipment of his motorcycle from Washington, District of Columbia to Manila, Philippines.
